GTC Original Football Shop
1. Scope of application
The following GTC apply to all orders placed via our online shop. Our online shop is aimed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.
2. contractual partner, conclusion of contract, correction options
The purchase contract is concluded with Tlalocan e.U. (FN FN 640844, Eisenstadt Commercial Register Court, registered office: Langsatzweg 7, 7000 Eisenstadt, Austria).
By placing the products in the online shop, we make a binding offer to conclude a contract for these products. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. The contract is concluded when you accept the offer for the products contained in the shopping basket by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

We save the contract text and send you the order data and our GTC in text form. For security reasons, the contract text is no longer accessible via the Internet.
4. hosting and platform
Our online shop is hosted on the Shopify Inc. platform, which provides us with the technical infrastructure to offer our products and services online.
5. delivery conditions
5.1 Shipping costs:
The shipping costs depend on the country of delivery and the order value as follows:
Austria
Shipping costs: €5 for orders under €100
Free shipping for orders over €100
European Union (EU)
Shipping costs: €10 for orders under €150
Free shipping for orders over €150
Other EU countries
Shipping costs: €20 for orders under €250
Free shipping for orders over €250
Note: For deliveries to countries outside the EU, additional customs duties, taxes or fees may apply, which must be borne by the customer.
5.2 Delivery options:
Delivery will be made to the delivery address specified in the order process.
6. payment
6.1 Prices:
The prices stated at the time of ordering shall apply. These are total prices. Due to the small business regulation according to § 6 Abs. 1 Z 27 UStG no VAT is shown.
6.2 Payment methods:
The following payment methods are available in our shop:
Prepayment: If you select the prepayment payment method, we will provide you with our bank details in a separate e-mail and deliver the goods after receipt of payment.
Credit card: You enter your credit card details during the ordering process. Your card will be debited immediately after placing the order.
PayPal and PayPal Express: To pay the invoice amount via PayPal, you must be registered there, legitimise yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further instructions during the ordering process.
7. special features for used individual items
All items offered are used individual items. Each product is given an individual description of its condition and a condition rating on a scale of 1 to 10. This condition description and condition rating are provided to the best of our knowledge and belief by an employee of the Original Football Shop and are based on the highest possible standards. They are given objectively and truthfully. Nevertheless, slight subjective deviations may occur. Normal signs of use due to age, which can be seen in the product description, do not constitute a defect within the meaning of the warranty.
8. Warranty and liability
8.1 The statutory warranty provisions under Austrian law apply. The warranty period for used goods is reduced to one year. This shortening does not apply to claims arising from injury to life, limb or health or from grossly negligent or intentional breaches of duty by us.
8.2 The items offered are collector's items and are not intended for regular use. Information on the condition of the goods is provided to the best of our knowledge.
8.3 All items offered are declared to be original football shirts to the best of our knowledge and belief.
If you have any doubts about the authenticity of the item, please inform us immediately. A guarantee for authenticity is assumed within the scope of the careful examination carried out by us; liability for undetected forgeries exists only in the case of gross negligence or intent.
9. right to refuse and cancel orders
We reserve the right to refuse orders or limit the quantities purchased, in particular in the event of suspected resale or fraudulent use.
10. third-party links and tools
Our website may contain links to third-party websites or third-party tools. We accept no liability for the content or use of such external offers.
11. prohibited uses
The use of our website or content for illegal purposes, to transmit viruses or destructive code or to violate legal provisions is prohibited. Offences will result in the immediate termination of our services.
12. cancellation policy (right of cancellation)
You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods. To exercise the right to cancel, you must inform us (Tlalocan e.U., Langsatzweg 7, 7000 Eisenstadt, Austria, E-Mail:flo@originalfootball.shop) of your decision to cancel this contract by a clear statement (e.g. a letter or e-mail). You can use the attached sample cancellation form, but this is not mandatory.
Consequences of cancellation
If you cancel this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from a type of delivery other than the standard type offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to cancel. We may refuse repayment until we have received the goods back or have received proof of return. You must return the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation. You shall bear the direct costs of returning the goods. There is no right of cancellation for contracts for goods that have been manufactured according to customer specifications or are clearly tailored to the personal needs of the customer.

13. reservation of right of correction and disclaimer
We reserve the right to correct, supplement or update information on the website at any time. Despite careful maintenance of the content, we accept no liability for typing errors, inaccuracies or omissions.
14. amendments to the GTC
We reserve the right to amend these GTC at any time. The current version shall apply. Users are requested to check the GTC regularly.
15. illustrations and colour deviations
The colours shown in the product photos may differ from the actual colour of the items for technical reasons. The item description is authoritative.
16. consumer information
16.1 In accordance with § 19 para. 3 AStG, we are obliged to inform consumers, if we cannot reach an agreement with them in a dispute, on paper or another permanent data carrier (e.g. e-mail) of the competent body for alternative dispute resolution.
16.2 The competent body for alternative dispute resolution is: Arbitration for Consumer Transactions, Internet Ombudsman.
16.3 We are not willing and not obliged to participate in a dispute resolution procedure before a consumer arbitration board.

17. applicable law, place of jurisdiction
Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as mandatory provisions of the law of the state of the consumer's habitual residence are not restricted. The place of jurisdiction is 7000 Eisenstadt in Austria.

19. duty of disclosure & data protection notice
19.1 Original Football Shop respects the privacy of its customers to the highest degree. All customer data is treated as strictly confidential and is never passed on to third parties. Original Football Shop is obliged to comply with the relevant version of the Austrian Data Protection Act. Further information can be found in the privacy policy available at voltalux.at, which can be viewed on the website originalfootball.shop.
19.2 The customer has the right to obtain information about the personal data processed by Original Football Shop within the meaning of Art. 15 GDPR.
19.3 The customer has the right to demand from Original Football Shop the immediate correction of personal data concerning him/her if it is incorrect or incomplete (Art. 16 GDPR).
19.4 The customer has the right, under the conditions described in Art. 17 GDPR, to request Original Football Shop to delete the personal data concerning him/her. This applies in particular if the personal data is no longer required for the purposes for which it was collected, the customer has withdrawn their consent or the processing was unlawful.
19.4 The customer has the right to request Original Football Shop to restrict the processing of their personal data if the requirements of Art. 18 GDPR are met. This right exists in particular if the accuracy of the data is disputed by the customer, the processing is unlawful or the data is no longer required by Original Football Shop, but the customer needs it to assert legal claims.
19.5 The customer has the right to receive the personal data concerning him or her, which he or she has provided to Original Football Shop, in a structured, commonly used and machine-readable format and has the right to transmit those data to another controller, where the processing is based on consent or on a contract and is carried out by automated means (Art. 20 GDPR).
19.6 Notification of data protection violations
The customer has the right to lodge a complaint with a data protection authority if they believe that the processing of their personal data violates the GDPR (Art. 77 GDPR). In Austria, the competent supervisory authority is the following

Apart from this, the customer will be informed immediately by Original Football Shop in the event of an expected high risk of a breach of data protection regulations.
20. severability clause
Should individual provisions of these General Terms and Conditions be invalid or lose their legal validity at a later date, the contract and the validity of these General Terms and Conditions shall remain unaffected. The relevant statutory provisions shall then apply. The ineffective provision shall be replaced by the relevant statutory provision or, depending on the mutual intentions of the parties, shall be amended.
